45 ദിവസങ്ങൾക്ക് ശേഷം ആദ്യമായി വിഷയം ഉന്നയിച്ചതല്ല

എന്റെ ആദ്യത്തെ വിശദമായ എഴുത്തുപരമായ ഇമെയിൽ കൺവൻഷൻ കഴിഞ്ഞ് ഏകദേശം ഒരു മാസത്തിനു ശേഷമാണ് അയച്ചത്. എന്നാൽ എന്റെ ആശങ്കകൾ ആരംഭിച്ചത് അപ്പോഴല്ല.

കൺവൻഷൻ കഴിഞ്ഞ് ഏതാനും മണിക്കൂറുകൾക്കുള്ളിൽ തന്നെ തിരഞ്ഞെടുപ്പ് നടപടികളുമായി ബന്ധപ്പെട്ട എന്റെ ആശങ്കകൾ ചീഫ് ഇലക്ഷൻ കമ്മീഷണറുമായും ജുഡീഷ്യറി കമ്മിറ്റി ചെയർമാനുമായും പലതവണ സംസാരിച്ചിരുന്നു. ഈ വിഷയത്തിൽ ഇനി എന്ത് ചെയ്യണമെന്ന് ചോദിച്ചപ്പോൾ, എനിക്ക് ഉചിതമെന്ന് തോന്നുന്ന നടപടികൾ സ്വീകരിക്കാം എന്ന തരത്തിലുള്ള മറുപടിയാണ് ലഭിച്ചത്.

തുടർന്നാണ് സെപ്റ്റംബർ 2-ന് എന്റെ ചോദ്യങ്ങൾ രേഖപ്പെടുത്തി Election Commission-ന് ഇമെയിൽ അയച്ചത്. സെപ്റ്റംബർ 16-ന് election-related electronic records, audit logs, access records, timestamps തുടങ്ങിയവ preserve ചെയ്യണമെന്നാവശ്യപ്പെട്ടും വീണ്ടും എഴുത്തിൽ സമീപിച്ചു.

അതുകൊണ്ട് 45 ദിവസങ്ങൾക്ക് ശേഷം ആദ്യമായാണ് ഞാൻ വിഷയം ഉന്നയിച്ചതെന്ന ധാരണ സംഭവങ്ങളുടെ പൂർണ്ണമായ സമയക്രമം പ്രതിഫലിപ്പിക്കുന്നില്ല.

ഫലം അംഗീകരിക്കുന്നതായി എന്റെ ഇമെയിലിൽ തന്നെ വ്യക്തമാക്കിയിരുന്നു

സെപ്റ്റംബർ 2-ലെ എന്റെ ഇമെയിൽ ആരംഭിക്കുന്നത്:

“We acknowledge and accept the officially declared results of the recent FOMAA election. This communication is not intended to challenge or alter the outcome.”

എന്ന വാക്കുകളോടെയാണ്.

അതേ കത്തിൽ:

“This is not about winners or losers, nor is it a request to change the declared result.”

എന്നും വ്യക്തമാക്കിയിരുന്നു.

അതുകൊണ്ട് എന്റെ ലക്ഷ്യം തിരഞ്ഞെടുപ്പ് ഫലത്തെ ചോദ്യം ചെയ്യുകയല്ല; election process സംബന്ധിച്ച ചില ചോദ്യങ്ങൾക്ക് രേഖാപരമായ clarification നേടുക എന്നതാണ്.

Election Commission-നോടുള്ള ബഹുമാനവും നന്ദിയും

ഈ അവസരത്തിൽ ഒരു കാര്യം പ്രത്യേകം വ്യക്തമാക്കാൻ ആഗ്രഹിക്കുന്നു. Election Commission-നെ കുറ്റപ്പെടുത്തുകയോ അപമാനിക്കുകയോ അവരുടെ സേവനത്തെ ചെറുതാക്കി കാണിക്കുകയോ ചെയ്യുന്നത് എന്റെ ലക്ഷ്യമല്ല.

തിരഞ്ഞെടുപ്പ് നടത്തുന്നതിനായി Election Commission അംഗങ്ങൾ ചെലവഴിച്ച സമയത്തെയും പരിശ്രമത്തെയും ഞാൻ ബഹുമാനിക്കുകയും അഭിനന്ദിക്കുകയും ചെയ്യുന്നു. ഫോമയ്ക്കുവേണ്ടി അവർ നൽകിയ സമയത്തിനും സേവനത്തിനും ഞാൻ നന്ദി രേഖപ്പെടുത്തുന്നു.

ഞാൻ ഉന്നയിക്കുന്ന ചോദ്യങ്ങൾ വ്യക്തിപരമായി Election Commission അംഗങ്ങൾക്കെതിരെയുള്ള ആരോപണങ്ങളല്ല. ഒരു സ്ഥാനാർത്ഥി എന്ന നിലയിൽ തിരഞ്ഞെടുപ്പ് നടപടികളുമായി ബന്ധപ്പെട്ട ചില കാര്യങ്ങളിൽ രേഖാപരമായ വ്യക്തത തേടുക മാത്രമാണ് എന്റെ ഉദ്ദേശ്യം.

മറുപടി ആവശ്യപ്പെട്ടത് Election Commission-നോടാണ്

എന്റെ എഴുത്തുപരമായ ചോദ്യങ്ങൾ Election Commission-നാണ് നൽകിയിരുന്നത്. വിഷയവുമായി ബന്ധപ്പെട്ട ആശങ്കകൾ Judicial Committee Chairman-മായും ചർച്ച ചെയ്തിരുന്നു.

എന്നാൽ ആ ചോദ്യങ്ങൾക്ക് ബന്ധപ്പെട്ടവരിൽ നിന്ന് point-by-point രേഖാമൂലമുള്ള മറുപടി ലഭിക്കുന്നതിന് പകരം Executive Committee പൊതുവാർത്താ മാധ്യമത്തിലൂടെ പ്രതികരിക്കുകയായിരുന്നു.

എന്റെ കാഴ്ചപ്പാടിൽ, തിരഞ്ഞെടുപ്പ് നടത്തിപ്പുമായി ബന്ധപ്പെട്ട് Election Commission-നോട് ചോദിച്ച ചോദ്യങ്ങൾക്ക് ആദ്യം അവരിൽ നിന്നുതന്നെ ഔദ്യോഗികവും രേഖാമൂലമുള്ളതുമായ മറുപടി ലഭിക്കുന്നതായിരുന്നു കൂടുതൽ ഉചിതം.

അതുകൊണ്ട് എന്റെ യഥാർത്ഥ ചോദ്യങ്ങൾക്ക് ബന്ധപ്പെട്ടവരിൽ നിന്ന് രേഖകളുടെ അടിസ്ഥാനത്തിലുള്ള മറുപടി നൽകണമെന്ന അഭ്യർത്ഥന ഞാൻ ആവർത്തിക്കുന്നു.

ഔദ്യോഗിക പ്രഖ്യാപനത്തിന് മുമ്പ് results ലഭ്യമായിരുന്നോ?

Executive Committee-യുടെ വാർത്താക്കുറിപ്പിൽ ഔദ്യോഗിക പ്രഖ്യാപനത്തിന് മുമ്പ് election result പുറത്തുപോയിട്ടില്ലെന്നും വിജയാഘോഷം പ്രഖ്യാപനത്തിനു ശേഷമാണ് നടന്നതെന്നും പറയുന്നു.

ആ പ്രസ്താവനയ്ക്ക് മറുപടിയായി ആരെങ്കിലും result leak ചെയ്തുവെന്ന നിഗമനം ഞാൻ മുന്നോട്ടുവയ്ക്കുന്നില്ല. ഞാൻ ആവശ്യപ്പെടുന്നത് electronic records എന്താണ് കാണിക്കുന്നത് എന്ന വ്യക്തതയാണ്.

പ്രധാനമായും വ്യക്തമാക്കേണ്ടത്:

• Election കൃത്യമായി എപ്പോൾ close ചെയ്തു?
• Final results എപ്പോൾ generate/tabulate ചെയ്തു?
• Results administrators-ന് എപ്പോൾ ലഭ്യമായി?
• ആർക്കൊക്കെയാണ് administrative access ഉണ്ടായിരുന്നത്?
• ഔദ്യോഗിക പ്രഖ്യാപനത്തിന് മുമ്പ് ഏതെങ്കിലും authorized account results access ചെയ്തിരുന്നോ?

ലഭ്യമായ electronic records അടിസ്ഥാനമാക്കി ഈ ചോദ്യങ്ങൾക്ക് മറുപടി നൽകാൻ കഴിയുമെങ്കിൽ, സംശയങ്ങൾക്ക് വ്യക്തത വരുത്താനുള്ള ഏറ്റവും നല്ല മാർഗം അതായിരിക്കും.

Simply Voting-നെതിരെ ഞാൻ ആരോപണം ഉന്നയിച്ചിട്ടില്ല

Simply Voting വോട്ടുകളിൽ മാറ്റം വരുത്തിയെന്നോ election result manipulate ചെയ്തെന്നോ ഞാൻ ആരോപിച്ചിട്ടില്ല.

എന്റെ ചോദ്യം 2026 FOMAA election-ൽ Simply Voting system എങ്ങനെ administer ചെയ്തു എന്നതിനെക്കുറിച്ചാണ്.

അതുകൊണ്ടാണ് ബന്ധപ്പെട്ട audit information, logs, timestamps, administrator-access information തുടങ്ങിയ electronic records preserve ചെയ്യണമെന്നും ലഭ്യമായ പരിധിയിൽ പരിശോധിക്കണമെന്നും ഞാൻ ആവശ്യപ്പെട്ടത്.

Live Results functionality 2026 FOMAA election-ൽ enable ചെയ്തിരുന്നോ, enable ചെയ്തിരുന്നെങ്കിൽ അതിന് authorization ഉണ്ടായിരുന്നോ, enable ചെയ്തിരുന്നില്ലെങ്കിൽ election close ചെയ്ത സമയത്തിനും ഔദ്യോഗിക പ്രഖ്യാപനത്തിനുമിടയിൽ results access ചെയ്തിട്ടുണ്ടോ എന്നതിലും രേഖാപരമായ വ്യക്തതയാണ് ഞാൻ തേടുന്നത്.

Waiver സംബന്ധിച്ച ചോദ്യം

ഫലം പ്രഖ്യാപിക്കുന്നതിന് മുമ്പ് സ്ഥാനാർത്ഥികളോട് waiver ഒപ്പിടാൻ ആവശ്യപ്പെട്ടതിന്റെ ഉദ്ദേശ്യം എന്തായിരുന്നു എന്നതും എന്റെ ആദ്യത്തെ ചോദ്യങ്ങളിൽ ഒന്നായിരുന്നു.

Executive Committee-യുടെ വാർത്താക്കുറിപ്പിൽ, ഫലം അംഗീകരിക്കാനും പിന്നീട് പരാതികളോ നിയമനടപടികളോ ഉണ്ടാകാതിരിക്കാനുമാണ് waiver ഒപ്പിട്ടു വാങ്ങുന്നതെന്ന് വിശദീകരിച്ചിട്ടുണ്ട്.

അങ്ങനെയെങ്കിൽ, സ്ഥാനാർത്ഥികൾക്ക് ഫലം അറിയുന്നതിന് മുമ്പ് തന്നെ അത്തരമൊരു waiver ഒപ്പിടാൻ ആവശ്യപ്പെട്ടതിന്റെ കാരണം എന്തായിരുന്നു എന്നതാണ് എന്റെ ചോദ്യം.

Waiver-ന്റെ copyയും അതിലെ കൃത്യമായ terms and conditions-ഉം നൽകണമെന്നും ഞാൻ ആവശ്യപ്പെട്ടിട്ടുണ്ട്.

Records preserve ചെയ്യണമെന്ന ആവശ്യം

സെപ്റ്റംബർ 16-ലെ എന്റെ കത്തിൽ election സംബന്ധിച്ച logs, reports, access information, electronic data തുടങ്ങിയവ preserve ചെയ്യണമെന്ന് പ്രത്യേകം ആവശ്യപ്പെട്ടിരുന്നു.

അതിന്റെ ലക്ഷ്യം വളരെ ലളിതമാണ്: ഫലം എപ്പോൾ ലഭ്യമായി, ആർക്കാണ് authorized access ഉണ്ടായിരുന്നത്, എപ്പോൾ access ചെയ്തു എന്നതിന്റെ documented and verifiable timeline സ്ഥാപിക്കുക.

Election Commission അംഗങ്ങളെ ഞാൻ ബഹുമാനിക്കുകയും അവരുടെ സമയത്തിനും സേവനത്തിനും നന്ദി രേഖപ്പെടുത്തുകയും ചെയ്യുന്നു. ഈ വിഷയം അവർക്കെതിരെയുള്ള വ്യക്തിപരമായ ആരോപണമായി കാണേണ്ടതില്ല.

Dear FOMAA Election Commission and Simply Voting,

I am writing as a candidate in the 2026 FOMAA election to formally request the immediate preservation of all records, logs, reports, communications, and electronic data relating to the election conducted through the Simply Voting platform.

Questions have been raised regarding the timing of access to the election results, including indications that individuals may have known the outcome before the Election Commission officially announced it. This letter does not presume how that occurred or allege that Simply Voting altered the results. The purpose of this request is to preserve the objective electronic record so that the sequence of events can be independently established.

Please preserve and, where permitted, provide the following:

The exact opening and closing times of the election.
The exact time the votes were tabulated and results generated.
The exact time the results first became available or accessible to any administrator or authorized individual.
Confirmation of whether Simply Voting’s “Live Results” feature or any other early-results functionality was enabled. If so, please identify when and by whom it was requested or authorized.
All available administrator/account audit logs covering the period before the polls closed through the official announcement of the results, including usernames, timestamps, login/access records, and IP-address information.
Records showing which authorized accounts accessed, viewed, downloaded, exported, printed, or otherwise obtained the results and the corresponding timestamps.
Records of any changes to administrator permissions, voter eligibility, election closing time, election configuration, tabulation settings, or result-release settings.
The official/certified election results report and any detailed results or audit reports generated by the system.
Copies or identification of any waiver, agreement, authorization, instruction, or restriction between FOMAA, the Election Commission, and Simply Voting concerning election records, detailed results, audit information, or access to such information.
Confirmation as to whether any election data, logs, audit records, or associated information have been archived, deleted, destroyed, or scheduled for deletion.
This request is particularly concerned with preservation. Therefore, please do not delete, archive in a manner that destroys underlying records, overwrite, or otherwise dispose of any potentially relevant electronic records while these questions remain under review.

If Simply Voting cannot release particular records directly to a candidate because FOMAA is the account holder, please preserve those records and identify the authorization or procedure necessary for their release.

I respectfully request written acknowledgment that this preservation request has been received and that relevant records will be retained.

The objective is straightforward: to establish a documented and verifiable timeline of when the results became available, who had authorized access to them, and when they were accessed.

Sub: Request for Clarification Regarding FOMAA Election Procedures

Dear Members of the FOMAA Election Commission,

We acknowledge and accept the officially declared results of the recent FOMAA election. This communication is not intended to challenge or alter the outcome.

However, certain procedural concerns require clarification to ensure confidence in the transparency, impartiality, and integrity of FOMAA’s election process.

1. Candidate Waiver
Candidates were asked to sign a waiver before the official announcement of results. Please clarify its purpose, why it was required at that stage, whether it limited any right to request records or review the process, and provide a copy of the waiver.

1. Presence of FOMAA Officials During the Election Process
Article XII of the FOMAA By-Laws states that while the Executive Committee shall cooperate with the Election Commission, “No officials of FOMAA shall intervene in any activities of elections.”

Despite this, Executive Committee members were observed with the Election Commissioner while the results were being reviewed prior to the official announcement.

Please clarify their official role, who authorized their presence, whether they viewed or participated in reviewing the results, and how this was consistent with Article XII. The involvement of a sitting officials with one among them

also a candidate raises an additional concern regarding actual or perceived conflict of interest.

1. Electronic Voting System and Audit Trail
Candidates were not given an opportunity to observe, or later provided documentation regarding, the formal closing of the voting system and generation of the final results.

Please clarify:

* Who had administrative access to the voting system;
* Who opened and closed the election;
* When voting was officially closed;
* Who accessed or generated the results;
* What verification procedures were followed; and
* Whether audit logs and access records exist and have been preserved.

This request does not seek individual ballot information or anything that would compromise voter secrecy.

1. Knowledge of Results Before Official Announcement
One panel appeared to begin celebrating approximately thirty minutes before the Election Commission officially announced the results.

Please clarify whether any candidate, panel member, Executive Committee member, or other individual had access to preliminary or final results before the official announcement and, if so, how such information became available.

1. Detailed Election and Audit Records
We understand that a waiver or arrangement with Simply Voting may have been cited as a reason for not providing additional election records.

Please clarify and provide, to the extent legally and contractually permissible:

* Total eligible voters and ballots cast;
* Available Simply Voting election and audit reports;
* Administrative access records;
* Poll opening and closing records;
* Result-generation and verification reports; and
* The specific basis for withholding any records that cannot be released.

We also respectfully request that all election-related records, including audit logs, waivers, access records, system reports, and relevant communications, be preserved.

This is not about winners or losers, nor is it a request to change the declared result.

It is about ensuring that FOMAA elections are conducted in accordance with the By-Laws and through a process that is impartial, secure, auditable, and transparent.

We respectfully request a written response addressing the above concerns.
